Update: Albany Detective Refused And Failed Several Tests During DWI Stop
Recently, we posted about an Albany police department spokesman who was arrested for
DWI. Detective Miller was a well-known police officer and was very well decorated. As noted previously, he had two of the classic signs of intoxication -- glassy eyes and smelled of alcohol.
In addition, he was given the
walk and turn and
one-leg stand test. Detective Miller then refused a breathalyzer test--continuing a long tradition of law enforcement personnel using their knowledge and experience to refuse a test. He pleaded guilty to a reduced charge of Driving While Ability Impaired.
