Update: Police Officer Found Guilty For DWI
As we noted in an earlier post, a former San Antonio police officer was on trial for DWI. In the morning of November 2009, he crashed his car into a traffic barrier.
This trial garnered attention because the former police officer had been involved in an accident that was non-alcohol related. In 2006, he drove through a red light and crashed into a truck. The accident killed a 25-year-old man. A Bexar County grand jury did not indict him on any charges.
The mother of that victim told reporters that she hoped Officer Morales received the "same punishment as a private citizens would get, and that would the maximum - six months in jail and his peace officer's license revoked forever." She is correct; DWI is a
Class B Misdemeanor with a range of punishment (if there is not an open-container) of three days to six months in county jail. However, most first time offenders (those without a serious criminal conviction) rarely see the maximum barring any egregious facts.
