The Administration Of The Walk And Turn Test
Recently we have been addressing the three SFSTs and their use to investigate whether someone is committing the offense of DWI. A few weeks ago, we took an indepth look at the HGN and how it is supposed to be administered by the police. We will now turn our attention to the tests that the jury will most likely rely upon.
These are the Walk and Turn test and the One Leg Stand test. The reason that the jury will rely so heavily on these two tests is that the jury can actually see them. They are performed after the administration of the HGN. However, the HGN is not seen on video because the video is usually taken by an in-dash camera and the suspect and the officer are too far away from the camera to see the suspect's alleged nystagmus.
Thus, the Walk and Turn and the One Leg Stand test are perhaps the most important part of a DWI case. Stay tuned as we evaluate these two important tests.
