A man is facing third-degree felony charges after he hit a pedicab driver in downtown Austin. The man tried to flee the scene, but Austin traffic prevented him from escaping. To make things worse the driver told the police officer that he was drinking vodka and &-Up, taken two vicodens, and was blind in his left eye.
The State's theory will likely center around the argument that he was intoxicated due to a combination of drugs and alcohol. The State will ask, at the end of trial, for the trial court to submit a synergistic charge. This means they do not have to prove how much alcohol a person had or how much drugs a person had. Instead, they only have to prove that the combination of the two caused your intoxication.
