Fire Chief Resigns After DWI Charge
A fire chief in Dallas County, Missouri has resigned after being charged with DWI. In 2002 and 2004, the fire chief had been previously arrested for DWI. If this were Texas, he would be charged with
felony DWI. He was arrested after he backed into another car on personal time.
Felony DWI, in Texas, is a third degree felony and he could face two to ten years in prison. On top of this, a person could be forced to pay a $10,000 fine. As stated above, this fire chief was involved in an accident, which will be used as a sign of intoxication. Though accidents are very common, the State uses evidence of an accident for two purposes (1) to demonstrate that the person was intoxicated; and (2) to demonstrate to the jury the potential dangers of DWI.
