Police Spokesman Arrested For DWI
Detective Miller, Albany Police, was arrested Friday night for suspicion of DWI. He was driving a department assigned vehicle and was stopped for driving without the headlights on.
He failed the
SFSTs and was asked for his consent to a take a breath test. As usual, the law enforcement officer
refused to give a breath test. He was then arrested and charged with
DWI. Like Texas, he will have a hearing with Department of Motor Vehicles (in Texas, the hearing is with the Department of Public Safety) to determine if he will lose his license.
Detective Miller is probably very aware, though your average citizen is not aware, that in Texas, there is a
15 day rule. This states that in order to request a hearing on the suspension of your license the request must be made within 15 days. In order to protect your license,
