Can I Appeal The Decision By The Administrative Law Judge?
After the Department of Public Safety presents its case and the defense presents its case, the administrative law judge will issue his or her ruling. If the administrative law judge upholds the suspension of the driver's license, a person can appeal that decision. All appeals are to the county court at law in the county where the arrest took place. The only exception to this rule is if there is no county court at law, then the appeal is made to the constitutional county court.
An interesting aspect of this appeal, is that the appeal is on the administrative record alone. The reason why this is intereting is that when there is an appeal from a municipal court to the county court at law, the court will hear the case as if there was no underlying trial on the case. However, in a driver's license suspension, the county court will only review the record. Thus, the suspect does not get another chance to cross-examine the police officer again.
