New DWI Warnings

Effective September 1, 2011, the Texas Legislature passed a bill that will change the way the police request a blood or breath specimen if you have been arrested for driving while intoxicated. This change was made in the Texas Transportation Code Section 724.015. This change mandaties that officers now warn subjects arrested for DWI and BWI that "if a person refuses to submit to the taking of a specimen, the officer may apply for a warrant authorizing a specimen to be taken from the person".

This change has been reflected on the DIC-24. It is important to remember that all police officers must use the revised DIC-24 forms with the revision date of September 2011. If the police do not read the correct warnings to the suspect, then DPS will not be able to suspend his or her driver's license.
