The 15-day Rule

If you have been arrested for a DWI, you need to understand the 15-day rule.  If a law officer suspects that you are under the influence of alcohol due to erratic driving or other factor, they will pull you over.  Once pulled over, they may administer several field sobriety tests.  If the law officer considers that you have failed the field sobriety test, they will take you to the station.  Once at the station, a blood alcohol concentration (BAC)test will be administered.  This test is most frequently a breath test, but on occasion it may be a blood test.  If you refuse to take the BAC test, or you register above the legal limit of .08% on the test, you will be arrested and charged with a DWI.  The officer will then confiscate your license, and give you a temporary 40 day driver's license.
